Paragon Competitions Terms and Conditions.

Paragon Competitions operate prize competitions with both paid and free entry routes.

  1. Definitions and Interpretation

In these terms and conditions:

“Promoter” means Paragon Competitions Limited ;

“Website” means www.paragoncompetitons.co.uk;

“Social Media” means the Paragon Competitions Facebook page facebook.com/paragoncompetitionsuk and the Paragon Competitions Instagram page Instagram.com/paragoncompetitions (@paragoncompetitions)

“Account” means registering an account with a username and password on the Website, by providing full and accurate personal information as required by the Promoter;

“Account Holder” means the person who has registered an Account with the Website;

“Competition” means the competition which can be entered via paid Entry on the Promoter’s Website or via free postal Entry, and will result in the Winner being awarded a Prize, subject to these terms and conditions;

“Countdown Timer” means the countdown timer on the Website showing how long is currently left before the Competition will close.

 “Draw” means the selection process of the winning entry which is carried out using Random Picker;

“Entrant” means any person who enters a Competition either by paid Entry on the Promoter’s Website and/or by free postal Entry;

“Participate” means to enter a Competition either by paid Entry on the Promoter’s Website and/or by free postal Entry;

“Participant” means any person who enters a Competition either by paid Entry on the Promoter’s Website and/or by free postal Entry;

“You” means an Account Holder, Entrant, Participant or person who used the Website and/or Enters any Competitions.

“Entry” means the Entrant successfully purchasing an Entry on the Promoter’s Website or successfully being allocated an Entry by the Promoter following their free postal entry, subject to these terms and conditions;

“Entry Limit” means the maximum number of Entries an Entrant can make into each competition;

 “Entry” means successfully purchasing an Entry by the Entrant on the Website, and/or the confirmation of an Entry being allocated to the Entrant following a successful free postal entry;

“Maximum Number of Entries” means the maximum amount of Entries that are permitted for a Competition. The Competition will close once the Maximum Number of Entries is reached and the Draw will normally take place within 24 hours of the Competition closing;

“Random Picker” means randompicker.com which is an independent service for certified, unbiased, random Competition Draws;

“Google Random Number Generator” means the random number generator on google.co.uk which is an independent service for unbiased, random number generation;

“Winning Entry” means the Name and Ticket Number chosen in the Competition Draw which is carried out by Random Picker, or the Google Random Number Generator in the event of Random Picker being unavailable;

“Winner” means the person who was successfully allocated the Winning Entry after successfully purchasing an Entry on the Promoter’s Website or successfully being allocated an Entry by the Promoter following their free postal entry, subject to these terms and conditions. The Winner must provide proof of identity which matches the details they provided when entering a Competition in order to receive the Prize;

“Prize” means the prize available for each Competition. The Promoter may operate multiple Competitions at the same time and each Competition will have one specific Prize;

“Proof of Identity” means a valid UK Passport or a current photo Driving License. Some other valid proofs may be accepted at the discretion of the Promoter;

All Definitions and Interpretations shall be equally applicable to both the singular and the plural forms of the terms defined.

  1. General

2.1 By opening an Account and Entering a Competition being ran by the Promoter on their Website, Account Holders and Entrants are deemed to have read and accepted these Terms and Conditions and agree to be bound by them.

2.2 Competitions cannot be entered without first creating an Account on the Website.

2.3 The Promoter reserves the right to close an Account Holder’s Account at any time, if they feel that the Account Holder has abused the services, has attempted to cheat in any way, has been abusive towards any employees of the Promoter, have been abusive towards any other Account Holders or Entrants or if the Promoter feels that it is not genuinely the Account Holder that is entering a Competition.

2.4 You may not assign or otherwise transfer (in whole or in part) your rights and/or obligations under these terms and conditions.

  1. Eligibility

3.1 Competitions will be open to all residents of Great Britain aged 18 and over, excluding:

3.1.1 employees of the Promoter;

3.1.2 family members of the Promoter’s Employees;

3.2 By Entering a Competition the Entrant confirms that they are eligible to Enter the Competitions and eligible to claim any Prize that they could win.

3.3 The Promoter reserves the right to refuse Entry to a Competition at their own discretion.

3.4 The Promoter will not accept Entries that are:

3.4.1 Entries made on behalf of another person or Account Holder;

3.4.2 Entries that have been automatically generated by a computer;

3.4.3 Entries that have been completed by a third party ;

3.4.4 Entries that are deemed to be fraudulent;

3.4.5 Entries that are deemed to have breached the Promoter’s terms and conditions;

3.4.6 incomplete postal Entries;

3.4.7 postal Entries which do not completely match an Account or where no Account has been registered on the Website before submitting a postal Entry.

3.4.8 made from a geographical location where Entry is prohibited.

3.5 Only one Account is permitted per person and any Account Holder found to have more than one account may have their Entries refused or disqualified, and their Accounts closed at the sole discretion of the Promoter.

  1. Competitions

4.1 The Competition is operated by the Promoter and the Promoter may operate multiple Competitions at the same time with each Competition having one specific Prize.

4.2 Each Competition will have its own specific page on the Website which will detail the Competition information such as the Entry options, the Competition Prize, the amount of Entries available, the amount of Entries sold and the time remaining before the Competition closes.

4.3 The availability of Competitions to enter and the pricing of Competitions on the Website are at the sole discretion of the Promoter and will be confirmed on the Competition pages on the Website.

4.4 The Promoter reserves the right to refuse Entry or disqualify Entrants if it reasonably believes that an Entrant has breached any of these terms and conditions.

4.5 The Competitions on the Website do not fall within the definition of a lottery under the Gambling Act 2005 and therefore can be operated legally in Great Britain without the need for any license. This is due to the Competitions having both a paid and free entry route.

  1. Competition Entry

5.1 To Enter a Competition, you must register and Account on the Website providing full and accurate personal details as required. You will be required to provide an email address and create a password for your account.

5.2 In order to successfully Enter a Competition the Account Holder must go to an active Competition page on the Website and successfully purchase their Entry(s).

5.3 You will not be deemed to have Entered a Competition until the Promoter confirms your Entry either by email or by adding your Entry(s) to the Recent Orders area of your Account.

5.4 All Entries to a Competition are final and refunds will not be given for any reason, except in cases that an Entry was made after the closing date and time of the Competition, or if the Promoter unexpectedly had to cancel the Competition.

5.5 A free Entry option is available for all Entrants by sending a postal Entry. 

5.5.1 to enter for Free by postal Entry, you must first create an Account on the Website, then clearly write on a Postcard, your full name, full address, email address used to register your Account, date of birth, contact telephone number and the name of the specific Competition you wish to enter to the Promoter. Free Entries must be posted to Paragon Competitions Limited, 3000 Aviator Way, Manchester Business Park, Manchester, M22 5TG. Postage must be paid by the Entrant and business postage solutions must not be used. Hand deliveries are not accepted, you must post all entries via the Royal Mail postal service.

5.5.2 free Postal Entries are limited to One Entry Per Person/Account, Per Competition, Per Postcard. All Entries must be sent individually and Postcards sent in envelopes will not be accepted.

5.5.3 in the interest of fairness, Paragon Competitions reserves the right to ban anybody that is suspected of misuse, cheating or automating entries. Any automated entries or suspected automated entries will not be accepted and anybody suspected or deemed to be attempting to make automated entries will be permanently banned from Paragon Competitions. Automated entries can include but is not limited to; printing post cards in volume, use of a franking machine or use of business postage solutions.

5.5.4 free postal Entries received while the Competition is still open will be allocated an Entry and will be treated exactly the same as a paid entry. Any free postal Entries received after the Competition has closed will not be entered into the Draw. You will not be deemed to have Entered a Competition until the Promoter confirms your Entry either by email or by adding your Entry(s) to the Recent Orders area of your Account.

5.5.5 free postal Entries with incomplete information will not be Entered into the Draw.

5.5.6 the Promoter will not be held responsible for any lost free postal Entries which don’t arrive at the Promoter’s address.

5.5.7 the Promoter will not be held responsible for any free postal Entries which do not arrive or are not processed before the Competition closes. A Competition may close due to all Entries being allocated or the countdown timer of the Competition reaching zero. In these instances, the free postal Entry will not be Entered into the Competition Draw.

5.5.8 all free Entries are processed on the day they are received by the Promoter. All free Entries that arrive at the Promoter’s office address while the Competition was still open will be Entered into the Draw.

5.6 An entry shall be declared void without any refund or credit being given to the Entrant, if the entrant is involved in any of the following: 

5.6.1 any form of fraud (actual or apparent); 

5.6.2 fraudulent misrepresentation; 

5.6.3 fraudulent concealment; 

5.6.4 hacking or interference with the proper functioning of the website;

5.6.5 holding or ‘ring fencing’ tickets in order to gain an unfair advantage over other entrants

5.6.6 unauthorised use of or amendment of any of the code related to the Website.

5.7 Each Competition has an Entry Limit per Account Holder which will be confirmed on the Competition Page.

5.8 By Entering a Competition you agree to be bound by these terms and conditions.

  1. Competition Period

Each Competition will run for a specific period which will be confirmed on the Competition page of the Website. The Competition will close when all of the Entries are allocated to Account Holders or when the Countdown Timer reaches zero.

  1. Draws

7.1 The Winner for a Competition will be Drawn live on Facebook (www.facebook.com) or any other live streaming internet channel that the Promoter chooses, using Random Picker (www.randompicker.com). In the event that Random Picker is unavailable, the Winner will be Drawn live using the Google Random Number Generator. Facebook do not own, sponsor or administer the Competition in any way.

7.2 The details of the live Draw will be added to the Website and posted on our Social Media following the closure of a Competition. The Draw will usually take place within 24 hours of the Competition closing.

7.3 Entry lists will be uploaded on to the Random Picker Website after the Draw.

7.4 There will be only one Winner per Competition unless otherwise specified by the Promoter on the Competition page.

7.5 All Entrants who had their Entry(s) confirmed by the Promoter following their purchase(s) or free postal Entry will be Entered into the Draw, except for circumstances whereby the Promoter refuses Entry or disqualifies an Entry due to a breach of these Terms and Conditions.

7.6 Random Picker will choose the Winning Name and Order ID by a certified, unbiased, random generator. The results are final and cannot be contested.

7.7 Entry lists will remain on the Random Picker Website following the Draw so that Entrants can check whether their Entry was in the Draw.

  1. Winners

8.1 The Winner picked in the Competition Draw is final, except for circumstances whereby an Entrant is disqualified for breaching these Terms and Conditions.

8.2 There will be only one Winner per Competition Draw unless expressly stated on the Website by the Promoter.

8.3 The Promoter will contact the Winner to arrange delivery of the Prize. If for any reason the Promoter is unable to contact the Winner using the details provided on the Winners Account within 7 days, or the Winner is found to have breached these Terms and Conditions, the Winner hereby agrees that they will forfeit the Prize and the Prize will remain as owned by the Promoter and in the Promoter’s possession. The Promoter may decide to extend the 7 day time period to contact the Winner at their sole discretion.

8.4 It is the responsibility of the Entrant to ensure that their personal details and contact details are correct and up to date on their Account.

8.5 The Winner will show a valid Proof of ID to the Promoter on or before delivery of the Prize and understands that any failure to show valid Proof of ID may result in the Winner being disqualified and forfeiting the Prize. The Promoter will then retain ownership of the Prize.

8.5 The Winner may also be required to provide proof of their age and Prizes will not be awarded to Winners who are found to be under the age of 18.

8.6 If the Winner has to forfeit the Prize for any reason and the Prize remains in the possession of the Promoter, the Promoter will Draw the Competition again and award the Prize to the Entrant who is picked as the Winner of the new Competition Draw.

8.7 The Winner’s details will be added to the Website and may also be used in marketing materials and on Social Media at any time in the present or future, and may include the Winner’s name, geographical location and details of the Prize won.

8.8 The Promoter will request the Winner to provide a photograph and/or video of themselves with the Prize, or will request to take a photograph and/or video of the Winner with the Prize, and the photographs and/or videos will be used on the Website and/or in marketing materials and/or on Social Media at any time in the present or future if the Winner provides consent to have the photograph and/or video taken.

  1. Prizes

9.1 Prizes will be selected by the Promoter at the Promoter’s sole discretion and will be added to the Website on the relevant Competition page.

9.2 At the sole discretion of the Promoter, the Prize may be substituted to a similar Prize of equal or greater value.

9.3 The Promoter owns any Prize from any Competition until it has been successfully handed over to a Competition Winner.

9.4 Prizes are non-negotiable, not transferable and cannot be substituted. Prizes must be accepted by the Winner as awarded by the Promoter.

9.5 Prizes will be delivered to the Winner’s home address in Great Britain free of charge, however in the event that the Prize needs to be delivered to an address outside of Great Britain, delivery fees may be charged and must be accepted by the Winner in order to receive the Prize.

9.6 The Promoter may list the RRP (Recommended Retail Price) on the Competition page on the Website. The Promoter is not responsible and accepts no responsibility for the accuracy of the RRP (Recommended Retail Price), and the Promoter does not imply, suggest or guarantee the valuation of the Prize in any way. It is the Entrants sole responsibility to determine the value/valuation of the Prize by doing their own research, making their own judgement and/or taking their own legal advice before entering any Competition on the Website.

9.7 The Promoter accepts no liability for errors or omissions contained within the Competition Prize details, description or specification or any other part of the Website.

9.8 The Promoter is not responsible for the Prize in any way once it is handed over to the Winner. The Promoter provides no insurance or warranty on the Prize and the Prize cannot be returned to the Promoter or exchanged. Once the Winner has received the Prize it becomes their sole responsibility including any tax or duty which may be payable, and the Promoter accepts no liability.

9.9 If the Winner is unable to take delivery of the Prize, the Promoter will store the Prize on behalf of the Winner completely free of charge for up to 30 days. If the Winner is still unable to accept delivery of the Prize after 30 days, storage costs may be charged by the Promoter to the Winner and must be accepted by the Winner in order to receive the Prize.

9.10 The Prize will only be awarded to the Winner and cannot be claimed on their behalf by a third party, except if the Promoter at their sole discretion is happy that a third party is acting lawfully as an authorised representative of the Winner.

  1. Your Account

10.1 Your Account Details including your email address and password should be kept confidential at all times and should never be shared with anybody else. When creating a password you should ensure that it is not something anybody else could guess and it should not contain your name or easy to guess number or letter sequences. You should never write down your password.

10.2 You should ensure that you log out of your Account after each use to prevent anybody else accessing your Account after you have left the computer, laptop or mobile device that you used to log into your Account.

10.3 You should maintain good internet security to ensure that your Account password cannot be compromised.

10.4 If you suspect your Account details and/or password may have been compromised in any way, you should contact the Promoter immediately.

10.5 Your password can be reset at any time by following the instructions on the Website if you have forgotten it.

10.6 The Promoter shall not be responsible and/or liable for any and/or all consequences that may arise out of and/or relate to any breaches of this clause 10. 

  1. Limitation of Liability

11.1 The Promoter makes and/or gives no representations and/or warranties and/or assurances of any nature regardless of how they arise (and whether in writing or otherwise) as to the value, quality, suitability and/or appropriateness for any particular purpose of any of the goods or services listed on the Website, marketing materials and/or Social Media, and/or offered and/or provided as Prizes. Save for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person and/or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its employees, suppliers, servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the Winner(s) and, where applicable, to any family/person(s) accompanying the Winner(s), or in connection with any of the Competitions listed by the Promoter.

11.2 The total maximum aggregate liability of the Promoter to each Winner shall be limited to the total value of each Prize that has been won by the Winner.

11.3 The total maximum aggregate liability of the Promoter to each Participant/Account Holder if they are not a Winner, shall be limited to the amount that the Participant/Account Holder has paid to enter Competitions in the first 12 months of Participating in any Competition on the Website.

11.4 The Promoter will not accept liability or responsibility for the following:

11.4.1 failed or incomplete Entries due to technical issues such as failed or compromised transmissions, computer hardware or software issues and/or malfunctions and/or failures, or telephone, network, internet or cable issues and/or malfunctions and/or failures.

11.4.2 Entries that are lost, damaged, delayed in post and/or transit, or mislaid regardless of the reasons.

11.5 The Promoter will reasonably endeavour to award the Prize to the correct Entrant. If for any reason due to technical issues, computer hardware, computer software, human error or any other related reason, the Prize is awarded to the incorrect Entrant, the Promoter reserves the right to immediately reclaim the Prize and the Prize must be returned to the Promoter immediately by the Entrant who incorrectly received the Prize or they must pay the Promoter the value of the Prize, at the Promoter’s sole discretion. If you believe and/or suspect you have received a Prize in error, you must notify the Promoter immediately.

11.6 The Promoter shall not be liable for any economic and/or any other loss and/or any consequential loss suffered or sustained to any persons who have received a Prize incorrectly and/or in error, and no compensation shall be due in any way to such persons.

  1. Unauthorised use of your payment method

If you notify your Bank or Building Society that your payment method has been used to purchase a Entry(s) on the Website and the Bank or Building Society requested a refund of the money for a particular Entry(s), that Entry(s) will be removed from any Draw and your Account may be suspended while we investigate the matter. The Promoter accepts no responsibility and will have no liability in a matter such as your Bank or Building Society requesting a refund or chargeback.

  1. Use of Website

13.1 You agree that the Website will only be used for your personal use and not for any commercial use in any way. You will only use the Website to enter Competitions from your Account as detailed in these Terms and Conditions.

13.2 You will not receive, access and/or transmit any content which is obscene, pornographic, threatening, racist, menacing, offensive, defamatory, in breach of confidence, in breach of any intellectual property right (including, without limit, copyright) and/or otherwise objectionable and/or unlawful, through the Website or the Promoter’s Social Media.

13.3 You agree to indemnify the Promoter against any and/or all costs, losses, damages and expenses which the Promoter may suffer and/or incur arising out of and/or in relation to any claim, legal proceeding and/or demand made by any third party due to and/or arising out of your unlawful, wrongful and/or negligent access and/or use of your account, the Website and/or breach by you of these terms and conditions.

13.4 The Promoter does not guarantee that the Website will display correctly on any particular devices it can be viewed on.

13.5 You agree that you will not access the Website and/or attempt to Enter any Competitions and/or Enter any Competitions whilst located anywhere other than in Great Britain.

13.6 Material on the Website is subject to Copyright, Trademark or License and you must not attempt to copy, remove or change and material on the Website.

13.7 The Website may contain hyperlinks to other third-party websites and such hyperlinks are provided only for your convenience and/or reference. The Promoter does not control and is not responsible for any third-party websites that the Promoter’s Website links to. You should take your own precautions before viewing, accessing or using any third-party website that the Promoter’s Website links to. The Promoter does not endorse the material on any third-party website and does not partner with any of the third-party websites unless expressly confirmed by the Promoter in writing on the Promoter’s Website.

  1. Changes to Terms and Conditions

The Promoter may update or change these Terms and Conditions from time to time and the most recent version will be added to this area of the Website as soon as possible. Please review this page periodically to ensure that you fully understand the terms and conditions that will apply at that time. The Promoter will also reasonably endeavour to email Account Holders when there is an update or change to the Terms and Conditions. Continuing to access or use the Website after changes to the Terms and Conditions come into effect is acceptance that you agree to be bound by the updated Terms and Conditions.

These Terms and Conditions have been written for sole use by Paragon Competitions Limited and any plagiarism of these Terms and Conditions will result in legal action.

Microsoft Email Issues

We are aware of an issue effecting all Microsoft email addresses.

This includes @hotmail.com / @outlook.com / @msn.com / @live.com 

Customers are not receiving emails from our site on these addresses.

We’re working to resolve the issue but this could take up to 24 hours. 

You can always check your tickets under My Account > Tickets, regardless of getting an email or not.

Free Postal Entry

A free Entry option is available for all Entrants by sending a postal Entry.
